Terms of Service

1. Acceptance of Terms

By accessing or using JustYes.ID ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including individual users verifying their age and partner sites integrating the Service.

2. Description of Service

JustYes.ID is a privacy-preserving age verification platform that:

• Verifies that users meet minimum age requirements using government-issued identification
• Issues cryptographic credentials stored locally on the user's device
• Enables partner sites to confirm a user's age-verified status without accessing their identity
• Generates compliance receipts as required by applicable state laws

3. Eligibility

You must be at least 18 years old to use JustYes.ID. By creating an account or completing a verification, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User Accounts and Security

When you create an account, you are responsible for:

• Truthful verification: Submitting only your own, authentic government-issued ID. Submitting fraudulent, altered, or another person's identification is a violation of these Terms and may constitute a criminal offense.
• PIN security: Keeping your 6-digit PIN confidential. JustYes.ID cannot access or reset your PIN.
• Recovery phrase: Safely storing your 12-word recovery phrase. This is the only way to recover your account if you forget your PIN. JustYes.ID cannot recover your account without it.
• Device security: Maintaining reasonable security on the device where your encrypted vault is stored.

5. Partner Site Terms

If you are a partner site integrating JustYes.ID, you additionally agree to:

• Use the Service only for lawful age verification as required by applicable law
• Not attempt to extract, reverse-engineer, or derive user identity from JWTs, receipts, or any data provided by the Service
• Protect your API keys and not share them with unauthorized third parties
• Comply with all applicable laws regarding age-restricted content and services
• Pay all fees associated with your billing plan in a timely manner
• Display appropriate notice to users that age verification is powered by JustYes.ID

6. Billing and Payments (Partners)

Partner sites are billed according to their selected plan:

• Entry Plan: $0/month base fee, $1.50 per verification, 0 included verifications
• Pro Plan: $250/month base fee, $0.75 per verification, 300 included verifications
• Enterprise Plan: Custom pricing, contact sales

Billing cycles are monthly. Unpaid invoices may result in service suspension. Plan changes take effect at the start of the next billing cycle.

7. Consent and Data Sharing

Each time you share your age-verified status with a partner site, you will be asked for explicit consent. You may revoke consent at any time. However, verification receipts already generated cannot be deleted, as they may be required for legal compliance.

8. Prohibited Uses

You may not:

• Use another person's identity or ID for verification
• Attempt to circumvent, disable, or interfere with the Service's security features
• Reverse-engineer, decompile, or attempt to extract source code from the Service
• Use the Service to facilitate any illegal activity
• Create multiple accounts to evade restrictions or bans
• Use automated tools to access the Service without prior written authorization

9. Account Deletion

You may delete your account at any time. Deletion permanently removes your encrypted vault and credential. Anonymized verification receipts and consent records are retained as required by law. Account deletion cannot be undone.

10. Intellectual Property

The Service, including its design, code, documentation, and brand assets, is owned by JustYes.ID and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTYES.ID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless JustYes.ID, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Modifications

We may modify these Terms at any time. Material changes will be communicated through the platform at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or applicable law. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) will survive.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
